Privacy Policy

This Privacy Policy explains how Transacta Brokers S.L. ("we", "us") collects, uses and protects personal data when you use transactabrokers.com or our brokerage and facilitation services.

We process personal data in accordance with the GDPR (EU) 2016/679 and Spanish Organic Law 3/2018 (LOPDGDD).

2. Information We Collect

• Identity and contact data: name, email, phone/WhatsApp, and other details you send when enquiring.
• Transaction and AML/KYC data: where you proceed with a deal, documents needed for customer due diligence (for example passport/ID, proof of address, NIE, company/UBO documents, source-of-funds / source-of-wealth information, and available digital-asset transaction history).
• Technical data: IP address, browser type, device/OS, access times and pages viewed (server logs and any analytics only if enabled with consent — see our Cookie Policy).
• Wallet or payment references: only where needed to coordinate settlement through regulated payment rails (we do not operate as a crypto exchange).

Our services are directed to adults. We do not knowingly collect data from children under 18 for brokerage enquiries.

3. Purposes and Legal Bases

• Responding to enquiries, viewings and deal coordination — performance of a contract or steps prior to a contract (Art. 6(1)(b) GDPR).
• AML/KYC, identity and source-of-funds checks, record-keeping — legal obligation as an obligated entity under Spanish AML rules (Ley 10/2010 and related regulations) (Art. 6(1)(c)).
• Coordinating crypto-to-fiat settlement through regulated payment rails and preparing notary documentation — contract / pre-contract (Art. 6(1)(b)) and legal obligation where applicable (Art. 6(1)(c)).
• Site security, fraud prevention and essential technical operation — legitimate interests (Art. 6(1)(f)), balanced against your rights.
• Optional analytics or marketing communications — consent (Art. 6(1)(a)), which you may withdraw at any time.

4. Recipients

We do not sell your personal data. We may share data with:

• Spanish notaries, lawyers and land registry officials, as required to complete a transaction;
• specialist AML/compliance support providers acting as processors under contract;
• regulated payment-rail providers involved in crypto-to-fiat settlement for your deal;
• hosting, IT and communications providers (including email and WhatsApp/Meta messaging channels);
• competent authorities where legally required (for example SEPBLAC or courts).

Client-facing materials do not name individual payment or compliance vendors. Processors are bound by data-processing terms where required.

5. International Transfers

Some providers (for example cloud hosting or messaging apps such as WhatsApp) may process data outside the EEA. Where that occurs, we rely on an adequacy decision and/or appropriate safeguards such as Standard Contractual Clauses, unless a specific exemption applies.

6. Retention

• Enquiry data: kept as needed to handle your request, then deleted or minimised unless a deal proceeds or a longer legal duty applies.
• AML/KYC and deal files: retained for the statutory period under Spanish AML law (typically ten (10) years under Ley 10/2010). The right to erasure does not override that retention duty.
• Technical logs: kept for a short period for security and diagnostics unless needed longer for an incident or legal claim.

7. Security

We apply appropriate technical and organisational measures. No method of transmission or storage is completely secure; we cannot guarantee absolute security.

8. Your Rights

You may request access, rectification, erasure, restriction, objection, and portability, and withdraw consent where processing is based on consent, by emailing cameron@transactabrokers.com. You also have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD): www.aepd.es.

See our Cookie Policy. Non-essential cookies or similar technologies are used only with your prior consent where required.

10. Changes

We may update this Privacy Policy from time to time. The “Last updated” date at the top will change when we do.
